ScrapingDuck API Terms of Service

Welcome to ScrapingDuck!
These Terms of Service (“Terms”) govern your access to and use of the ScrapingDuck application programming interface (the “API”), and any other services offered by GSoftwareLab (“we,” “us,” or “our”). By accessing or using our API, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the API.
1. User Responsibilities and Acceptable Use
You, the user, are solely and entirely responsible for your use of the ScrapingDuck API. By using our service, you agree to the following:
- Legal Compliance: You are responsible for ensuring that your data collection activities are legal in your jurisdiction and in the jurisdiction of the websites you scrape. You must comply with all applicable laws, including but not limited to copyright law, privacy laws (such as GDPR, CCPA), anti-hacking laws, and any other regulations related to data scraping and processing.
- Third-Party Terms: You are responsible for reviewing and complying with the terms of service of any website or data source you access using the ScrapingDuck API. ScrapingDuck is a tool, and it is your responsibility to use it ethically and in a manner that respects the rights of others.
- Prohibited Activities: You agree not to use the ScrapingDuck API for any unlawful, harmful, or malicious activities, including but not limited to:
- Scraping personally identifiable information (PII) without legal basis or consent.
- Infringing on intellectual property rights, such as copyrights or trademarks.
- Conducting denial-of-service (DoS) attacks or otherwise imposing an unreasonable load on the infrastructure of third-party websites.
- Bypassing security measures (like CAPTCHAs) in a manner that violates a website’s terms of service.
- Distributing malware or engaging in any form of hacking.
GSoftwareLab does not endorse, support, or take responsibility for the specific data you collect or how you use it. The responsibility for lawful and ethical data scraping rests entirely with you.
2. Service Provision and Limitations
ScrapingDuck is provided on an “as is” and “as available” basis. GSoftwareLab does not warrant that the service will be uninterrupted, error-free, or completely secure. We provide the technical means to access web data, but we do not guarantee the availability or accuracy of data from third-party websites.
We reserve the right to modify, suspend, or discontinue the API, with or without notice, at any time.
3. Disclaimer of Warranties
GSoftwareLab explicitly disclaims all warranties, whether express, implied, or statutory, regarding the ScrapingDuck API, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. You use the service at your own risk.
4. Limitation of Liability
To the fullest extent permitted by law, GSoftwareLab shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from your use or inability to use the ScrapingDuck API. This includes, but is not limited to, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
You acknowledge that GSoftwareLab is not responsible for any legal action, financial penalties, or other consequences you may face as a result of your scraping activities.
5. Indemnification
You agree to indemnify, defend, and hold harmless GSoftwareLab, its affiliates, officers, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the ScrapingDuck API, your violation of these Terms, or your violation of any third-party rights, including any intellectual property rights.
6. Modification of Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website and updating the “Last Updated” date. Your continued use of the ScrapingDuck API after any such changes constitutes your acceptance of the new Terms.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GSoftwareLab is established, without regard to its conflict of law provisions.
